Les personnes r\u00e9sidant \u00e0 l\u2019\u00e9tranger ne peuvent acqu\u00e9rir des logements de vacances que dans les cantons qui ont introduit la base juridique correspondante. Ceux-ci sont actuellement au nombre de 17, dont un tiers environ sont confront\u00e9s \u00e0 une demande effective. L\u2019Office f\u00e9d\u00e9ral de la justice a ainsi relev\u00e9 les donn\u00e9es suivantes\u00a0: le nombre d\u2019autorisations accord\u00e9es, les transferts immobiliers r\u00e9ellement effectu\u00e9s, la surface des biens-fonds, la nationalit\u00e9 des acqu\u00e9reurs, le nombre d\u2019op\u00e9rations d’ali\u00e9nation entre \u00e9trangers et de rachat par des Suisses. Il a, en outre, dress\u00e9 un \u00e9tat de l’\u00e9puisement des contingents. <\/p>\n

Les contingents d\u2019autorisation ont \u00e9t\u00e9 peu sollicit\u00e9s<\/strong><\/h2>\n


\nLe Conseil f\u00e9d\u00e9ral a fix\u00e9 \u00e0 1500 par ann\u00e9e la limite maximale l\u00e9gale de contingents cantonaux d’autorisations. Comme par le pass\u00e9, un canton peut reporter sur l’ann\u00e9e suivante les unit\u00e9s qu’il n’a pas utilis\u00e9es durant celle en cours. Fin octobre de la deuxi\u00e8me ann\u00e9e, les autorisations non utilis\u00e9es retournent \u00e0 la Conf\u00e9d\u00e9ration et peuvent \u00eatre attribu\u00e9es \u00e0 un autre canton dont le contingent annuel est \u00e9puis\u00e9. Cependant, on ne peut lui octroyer que la moiti\u00e9 au plus de son contingent ordinaire. Aucun canton n’a eu besoin d’une telle rallonge en 2015.

\nCette ann\u00e9e, les 1500 unit\u00e9s disponibles pour l’ensemble du pays ont \u00e9t\u00e9 utilis\u00e9es \u00e0 hauteur de 33\u00a0%. L\u2019ann\u00e9e pr\u00e9c\u00e9dente, ce chiffre \u00e9tait de 44\u00a0%. \u00c0 titre de comparaison, en moyenne pluriannuelle, le taux d’\u00e9puisement des contingents se situait jusqu’en 2014 \u00e0 environ 80\u00a0%. Aujourd’hui, cette moyenne se situe \u00e0 un peu moins de 76\u00a0%. Le taux n\u2019a fait que diminuer depuis 2009.

\nL’utilisation des contingents cantonaux pour une ann\u00e9e ne concorde pas n\u00e9cessairement avec le nombre d\u2019autorisations accord\u00e9es. Celui-ci peut, globalement ou dans certains cantons, \u00eatre plus \u00e9lev\u00e9 que le contingent annuel. Il y a deux raisons \u00e0 cela\u00a0: <\/p>\n

  1. Les unit\u00e9s non utilis\u00e9es durant une ann\u00e9e peuvent \u00eatre report\u00e9es sur l’ann\u00e9e suivante.<\/li>\n

  2. Les autorisations de principe accord\u00e9es ant\u00e9rieurement (garanties d’autorisation aux promoteurs) peuvent encore \u00eatre utilis\u00e9es ult\u00e9rieurement pendant un certain temps.<\/li>\n

    Les autorisations et les transferts de propri\u00e9t\u00e9 s’affaissent<\/strong>

    \nEn 2015, on a d\u00e9livr\u00e9 en Suisse 701 autorisations \u00e0 des personnes r\u00e9sidant \u00e0 l’\u00e9tranger pour qu\u2019elles acqui\u00e8rent des logements de vacances, contre 964 l’ann\u00e9e pr\u00e9c\u00e9dente (voir tableau 1)<\/em>. La majeure partie d’entre elles ont \u00e9t\u00e9 attribu\u00e9es dans les cantons du Valais (289), des Grisons (111), du Tessin (93), de Vaud (93) et de Berne (92). <\/p>\n

    \nRemarque : des personnes r\u00e9sidant \u00e0 l\u2019\u00e9tranger peuvent \u00e9galement acqu\u00e9rir des logements de vacances dans les cantons de Nidwald, de Schaffhouse et du Jura. Ces trois cantons n\u2019ont toutefois enregistr\u00e9 aucun transfert en 2015.<\/span>

    \nLes statistiques sur les transferts de propri\u00e9t\u00e9, \u00e0 la diff\u00e9rence de celles sur les autorisations, recensent les acquisitions qui se sont concr\u00e9tis\u00e9es. \u00c0 long terme, environ 85\u00a0% de l’ensemble des autorisations donnent lieu \u00e0 une inscription au registre foncier. Les diff\u00e9rences entre les statistiques sur les transferts de propri\u00e9t\u00e9 et celles relatives aux autorisations s’expliquent par le fait qu’il s’\u00e9coule g\u00e9n\u00e9ralement plusieurs mois entre l’octroi d’une autorisation et l’inscription au registre foncier. Ces deux actes n’ont pas forc\u00e9ment lieu la m\u00eame ann\u00e9e. Il peut aussi arriver que des \u00e9trangers renoncent \u00e0 l’acquisition.

    \nEn 2015, on a enregistr\u00e9 466 transferts de logements de vacances, un nombre nettement inf\u00e9rieur aux 720 de l’ann\u00e9e pr\u00e9c\u00e9dente (voir tableau 1)<\/em>. La plupart des mutations au registre foncier ont \u00e9t\u00e9 effectu\u00e9es dans les cantons \u00e0 vocation touristique\u00a0: 257 en Valais, 100 aux Grisons, 39 au Tessin, 36 \u00e0 Berne et 11 dans le canton de Vaud. La r\u00e9partition des transferts selon la nationalit\u00e9 des acqu\u00e9reurs a peu \u00e9volu\u00e9. <\/p>\n

    \nPour calculer l’augmentation nette de la propri\u00e9t\u00e9 de logements de vacances en mains \u00e9trang\u00e8res, il faut d\u00e9duire du total des transferts, d’une part, les rachats par des Suisses et, d’autre part, les ali\u00e9nations entre \u00e9trangers. Pour 2015, cela repr\u00e9sente, apr\u00e8s d\u00e9duction de 163 transactions entre \u00e9trangers et de 765 rachats par des Suisses, une diminution de 462 logements de vacances (-252 logements l’ann\u00e9e pr\u00e9c\u00e9dente). En surface, cela correspond \u00e0 128,5 hectares de moins (-67,7 ha l’ann\u00e9e pr\u00e9c\u00e9dente). Des donn\u00e9es d\u00e9taill\u00e9es par canton peuvent \u00eatre tir\u00e9es du tableau 2<\/em>. <\/p>\n
